Data Information Notice

This notice is issued by 9381-9506 Québec Inc. ( “Vosker”), pursuant to Regulation (EU) 2023/2854 on harmonised rules on fair access to and use of data (the “EU Data Act”).

It sets out the information required to be provided to users regarding the data generated by the use of Vosker’s Connected Products and its Related Services (as defined herein), including the conditions for accessing, using and sharing such data, in accordance with the EU Data Act.

As a distributor and conceptor of connected surveillance products, Vosker undertakes to comply with the applicable obligations of the EU Data Act and to respect users’ data rights.

This notice applies to Connected Products and Related Services made available by Vosker in the European Union.

Definitions

Connected Product(s) means a suite of cellular outdoor security cameras with a range of functionalities and configurations offered by Vosker.

Related Services means a mobile and web application that enables access to monitoring of and management of the Connected Products.

Categories of Data Generated

Depending on the Connected Products configuration and usage, the Connected Products may generate the following categories of data:

  • usage data, such as operational status, system events and activity records;
  • technical and diagnostic data, including logs and error reports;
  • configuration data, such as device settings and user-defined parameters;
  • sensor-generated data, including images, video recordings and related metadata;
  • other data necessary for the operation, maintenance or improvement of the Connected Products and Related Services.

The data generated may include personal data and/or non-personal data, depending on the context in which the Connected Products and Related Services are used.

Data Format

The Categories of Data Generated may be generated in a variety of formats, including numerical, text-based, binary or similar data formats.

Estimated Volume

The data may vary significantly in volume, ranging from a minimum number of bytes to several hundred of megabytes, subject to the type and characteristics of the data.

Collection Frequency

On a continuous and/or real-time frequency, depending on the Connected Products model and the selected transmission plan.

Data Storage

The data is stored on the Connected Products and on a cloud located in the United States.

Duration of retention

SD Cards: Users retain full control over the data stored on the SD cards and Vosker does not have access to this data.

Application: Data remains accessible to the user for a limited period, depending on the chosen subscription, ranging from 7 to 60 days.

Access, Retrieval and Erasure of Data

SD Cards: Users retain full control over the data on the SD cards. Vosker does not access this data directly. Users may access, retrieve, or delete the data collected on the SD Cards at any time using their own devices. Data from the SD cards only becomes accessible to Vosker if the user uploads the data to the Related Services, where it is then managed like data from a Connected Product.

Application: Users may access, retrieve and or erase the data through the Related Services. Once deleted through the Related Services, the data is permanently removed from Vosker’s cloud and is no longer accessible. Users may also contact Vosker directly to request access, retrieval of undeleted data or erasure of the data.

Because of how certain data is handled, technical constraints, or the lack of integration with specific Connected Products or Related Services, there may be situations where the data cannot be accessed, retrieved or deleted.

Sharing/Third Party Use/Data recipient

Users may request that their data be shared with third parties or stop sharing previously shared data by contacting Vosker through the address listed in the “Contact” section. Not all requests can be carried out, as technical or legal restrictions may apply.

Vosker and certain authorized third-party providers may handle, store, or process user data to support the operation of Connected Devices and the delivery of Related Services.

Use and Purpose of Data Collection

Vosker may collect, process and retain the data described above for specific purposes, including:

  • Operating and maintaining the Connected Products and Related Services;
  • Assisting users with Connected Products and Related Services issues;
  • Improving the quality of the Connected Products and Related Services and developing new features and offerings;
  • Protecting users and the integrity of the Connected Products and Related services; and
  • Any additional purposes explicitly agreed by the user, including those outlined in the contract or terms of service.

Contract Duration

The duration of the contract between the user and Vosker depends on the type of Connected Products and Related Services selected. The duration and the term of the contract may vary depending on the user’s choice of a fixed term or monthly successive subscription to transmission plans that renew automatically. Users may terminate the contract at any time by contacting Vosker conditions may apply to the termination.

Complaint Rights

Users may lodge a complaint with the competent national authority if they consider that their rights under the EU Data Act have been infringed.
